These terms and conditions (the “terms”) govern Olio 3 Pty Ltd trading as Ethical Practice ABN 73 134 136 002 (now referred to as “Ethical Practice”) and each Love Your Practice 2017 retreat participant (now referred to as “participant”) that has registered and purchased a ticket to attend the Love Your Practice 2017 retreat (now referred to as “Retreat”) or has been invited by Ethical Practice to attend the Retreat.

 

1. WHEN DO THESE TERMS APPLY?

These terms will apply to participant registrations for the Retreat and apply whether the attendance is gratis or paid. When the participant registers, the participant acknowledges and accepts these terms in full.


2. PAYMENT & ATTENDANCE FOR THE RETREAT:

Specific payment rate offers are as below:

  • Barking Owl (Seriously Early Bird: until 28 Feb 2017): $595 incl gst.
  • Curlew (Early Bird: 1 March-31 May 2107): $695 incl gst.
  • Magpie Lark (Regular Price: 1 June-4 August 2017): $795 incl gst.

Payment plan arrangements are available in the form of multiple payments can be made, if the full amount of that specific payment rate bracket is paid by the end date of that ticket type. If the final payment of a payment plan is not received by 4 August 2017 all monies will be forfeit and attendance will not be permitted. Registrations may not be accepted after 4 August 2017. Registrations will be accepted until all places for the Retreat are sold. Acceptance of attendance is confirmed only when confirmation is made to the participant in writing either by hardcopy or email. Ethical Practice reserves the right to reject a registration. In these instances, a refund of any payment made by the person registered will be issued. If the Retreat is full, Ethical Practice can add your name to our waitlist upon request in writing. If a place becomes available and we confirm your place on the retreat, we will contact you and full payment will be due immediately. Registration includes morning tea, lunch and afternoon tea on the retreat days only. Any dietary requirements must be provided in writing to Ethical Practice 1 week prior to the Retreat. Registrations do not include travel or accommodation costs.


3. REFUNDS FOR THE RETREAT:

All cancellations must be received in writing. If the participant withdraws or transfers from the Retreat, the following refund policy applies:

  1. Full refund will be provided for cancellations in writing greater than one month prior to the Retreat commencement.
  2. Full cancellations in writing within the one month period prior to Retreat commencement result in a 50% refund – however, a full refund will be provided if that registration space is taken by another participant only when the retreat is fully booked. (paid in full by the new participant).
  3. Participants may nominate an alternate participant in writing (providing they meet audience profile and are accepted by Ethical Practice) in place of their attendance without attracting penalties.
  4. If a registered participant does not attend the Retreat, no refunds will be issued.
  5. Ethical Practice reserves the right to cancel any registration after confirmation. Ethical Practice will refund all fees paid in this circumstance. Participants acknowledge that the refund of registration fees is the only recourse in the cancellation of the Retreat. All other liability is excluded.
  6. Ethical Practice will not accept the transfer of registrations between Ethical Practice Retreats or other Ethical Practice services unless Ethical Practice confirms such arrangement in writing based on a written request by the participant.

4. RETREAT CANCELLATION

Ethical Practice reserves the right to cancel or change the date of the Retreat at any time for any reason, and its liability shall be limited to a refund in full of only the amount received from or on behalf of the participant. Ethical Practice shall not be held liable for any additional penalties incurred from the cancellation or date change, such as accommodation or travel arrangement.


5. PRICING

Prices for the Retreat are correct at the time of publication either via invitation or online. Ethical Practice reserves the right to change the prices at any time but changes will not affect registrations already confirmed by Ethical Practice. All prices are inclusive of gst.


6. TRAVEL & POSSESSIONS

It is the participant’s responsibility to ensure their own travel and accommodation arrangements are in order. Ethical Practice advises all participants to have travel insurance to include cover for the entire duration of the journey and Retreat. Ethical Practice does not accept any responsibility if participants have failed to organise appropriate insurance coverage for themselves. Each participant is responsible for carrying, protecting and securing his/her own baggage, and that of any guest they wish to travel and stay with. Ethical Practice does not accept responsibility for any possessions lost or damaged while in the custody of the airline, accommodation venue, Retreat venue, transportation vehicle or associated activities.


7. RETREAT COPYRIGHT AND CONSENT

All participants acknowledge that the material presented at the Retreat is copyrighted and cannot be re-used without the written express permission of Ethical Practice. All unauthorised photography and the recording or transmitting of audio or visual material, data or information is expressly prohibited. All participants consent to filming, sound recording and photography of the Retreat as an attendee and consent is given to Ethical Practice to use of any such recording or photography anywhere in the world for promotional and other purposes. Participants agree that they are not entitled to remuneration, residuals, royalties or any other payment from Ethical Practice in respect of their image/likeness or its use. Participants release, discharge, and hold harmless, Ethical Practice and its agents from any and all claims, demands or causes of actions that they may hereafter have by reason of anything contained in the photographs or video. Participants are responsible for notifying Ethical Practice regarding any information considered commercial-in-confidence or sensitive in nature that has been recorded by Ethical Practice if the participant wishes this information to be withheld from publishing and distribution by Ethical Practice. Participants grant Ethical Practice a royalty-free limited perpetual right to publish on any Ethical Practice website(s) and marketing material any photographs and videos taken or created by the participant and provided to Ethical Practice.


8. RETREAT PROGRAM MODIFICATIONS

Ethical Practice reserves the right at any time to change the Retreat format, content, location and timing or any other aspect of the Retreat, in each case without liability. In such case, Every effort will be made to ensure a program of equivalent standard.


9. BEHAVIOUR

Ethical Practice reserves the right to prohibit entry of any person to the Retreat event, or eject any person from the Retreat based on behaviour deemed inappropriate by Ethical Practice staff and/or its agents and others working under its authority.


10. LIMITATIONS OF LIABILITY

If services and accommodation advertised for the Retreat by Ethical Practice cannot be supplied due to causes beyond its control, there shall be no responsibility or liability. Such alterations will not be considered cause for cancellation by the participants, and the usual penalties will apply. Subject to any implied terms and to the maximum extent permitted by applicable law, Ethical Practice, its employees, agents and contractors will not be liable for personal injury or death, property damage, accident, delay, irregularity, or expense arising from strikes, war, terrorism, weather, or other acts of God, quarantines, sickness, governmental restrictions or regulations, or from any negligent action of any individual, firm, or corporation furnishing air travel, sightseeing, hotel accommodations, meals, ground transportation, or any other services in connection therewith, nor for any additional cost or expense due to disruption of advertised schedules, rates or services, or for any other cause beyond its direct control.


11. DISCLAIMER FOR LEISURE ACTIVITIES

Participants should consider carefully whether they will be able to participate in the leisure activities highlighted as suggestions for partners, children and/or the participants. Participants accept that it is entirely the participant’s responsibility, and not the responsibility of Ethical Practice, to decide whether participation in any activity is appropriate for them and it is also the participant’s responsibility to observe all safety requirements and instructions that the participant may be given in relation to any associated activities. To the extent permitted by law, neither Ethical Practice nor its officer or employees will accept any liability whatsoever for any direct, indirect, incidental, special or consequential damages, whether due to negligence or any other cause, arising from participation in any part of the leisure activities highlighted, including but not limited to activities outside the Retreat sessions. In the event of death or personal injury, the liability of Ethical Practice and its officers and employees is limited accordingly.


12. PRIVACY

Ethical Practice is committed to protecting the privacy and security of the participant’s personal information. Ethical Practice supports the privacy principles contained in the Privacy Act 1988 (Cth), as amended. In general, the personal information we collect includes (but is not limited to) the participant’s name, contact details (including phone numbers and addresses) and possibly financial information, including credit card information. Ethical Practice processes payments for Retreats using online technologies. All transactions processed by Ethical Practice meet industry security standards to ensure the participant’s details and payments are protected.

Ethical Practice also collects information about you that is not personal information. For example, Ethical Practice may collect data relating to the participant’s activity on our websites (including IP addresses) via tracking technologies such as cookies, or Ethical Practice may collect information from the participant in response to surveys. Ethical Practice generally uses this information to report statistics, analyse trends, administer Ethical Practice services, diagnose problems and target and improve the quality of Ethical Practice products and services. Ethical Practice will not disclose the participant’s personal information to third party providers to whom Ethical Practice has contracted such as mailing houses or Retreat operations.
